Singer Geoff Tate — who was fired from the Seattle progressive rock band QUEENSRŸCHE in 2012 after fronting it for three decades — and his former bandmates have requested more time to hammer out a settlement in their legal battle over the rights to the group's name.
King County Superior Court Judge Julia Garratt has signed a stipulation and order continuing trial date, allowing the parties two more weeks to come to an agreement over the use of the QUEENSRŸCHE name and its associated trademarks. If they cannot reach an agreement during that period, the trial is set to begin on February 10.
During an appearance this past week at the studios of the 98.7 The Gater radio station in West Palm Beach, Florida, Tate was asked for an update on the legal battle between him and his former bandmates over the rights to the QUEENSRŸCHE name. "Actually, we're in settlement talks right now," Tate said. "I hope it doesn't [go to trial]. I'm kind of hoping that it will all be settled by the end of the month."
Pressed on how he thinks it will all play out, Tate replied: "Either way, it's in my favor. So I'm just waiting for the paperwork to be dry."
Asked what it is like to perform with Geoff Tate's version of QUEENSRŸCHE, Sarzo said: "Geoff Tate is, to me, of his generation the finest composer, singer, frontman that ever was, of that generation. [He is] a joy to work with, to be in the band, to be in his company, to hear his voice on stage… off stage [as well], because he sings a lot off stage too. And he's got a wonderful band, including my brother [Robert] is in it. And also members of the QUEENSRŸCHE family that have been around for a long time, like Kelly Gray, Randy Gane… all those guys. And also I get to play with my old DIO rhythm section bandmate Simon Wright, so it's a very joyful occasion… It's a family. Absolutely. Otherwise, after a year, we wouldn't [still] be doing this. [Laughs]"
Regarding whether Tate includes him in the songwriting process, Sarzo said: "You know, what happened was, even before we went out on tour, Geoff needed to come out with a record to make a statement. So I played on three tracks [on the 'Frequency Unknown' album], [but] I was not part of the [songwriting] process [because] we weren't a band yet. So hopefully in the future, we'll be part of the [songwriting] process too."
During a brand new interview with the Colorado Springs, Colorado radio station KILO FM 94.3, singer Geoff Tate was asked if he has seen the article on BLABBERMOUTH.NET where legendary bassist Rudy Sarzo — who plays for Geoff Tate's version of QUEENSRŸCHE — called Tate "the finest composer, singer, frontman that ever was, of [Geoff's] generation." "No, I didn't see that," Geoff replied (hear audio below), before adding, "Well, that's very complimentary. He's quite a gentleman, Rudy. It's a pleasure playing with that guy. He is an amazing individual. Not only is he a fantastic musician and player, but as a person, he's one of the most down-to-earth, spiritual guys you'll ever meet. He's always calm. He's the kind of guy that you can sit and have a couple-of-hour conversation with, easy."
Tate was also asked about the progress of the settlement talks with his former bandmates over the rights to the QUEENSRŸCHE name. "I can't really talk about the court case anymore, 'cause it's kind of coming down to the end of it now," he said. "But whatever the outome of it is, I just hope that it's settled, for everyone, in a good way and everyone's happy and we can all part ways on good terms, and move on. And there's a lot of more music to come out, and I'm looking forward to that."

Do you have an update on when we can expect a resolution on the dual versions of the band?
That’s coming up. What I can say is that both sides have reached an amicable settlement and it’s now just a matter of time. There will be an official press release but for now, you’ll have to wait.
Has the band been working on new music?
Yes, we’ve already begun the process for the next album. We have probably six songs demoed so far. We’re taking it in a direction suited to what we do as Queensrÿche but maybe a little more progressive and heavier. The thing is, you never know what you really have until it’s complete. It’s like carving a piece of clay and seeing how it turns out. You peel off the layers until you get to something really cool.

Fast-forward to 2012. Early in the year (late January or early February, I think), Slater and I are talking, and he drops a bomb on me. He explains that the Tates have allegedly concocted a plan for Geoff to walk away from Queensrÿche after one last milking of Operation: Mindcrime.
Slater explained that the Tate’s were planning to do Mindcrime for a big pay day one final time. At the conclusion of that tour, Tate would then refuse to tour again with Queensrÿche, effectively putting an end of the band, and cutting off the ability for Wilton, Jackson and Rockenfield to make a living touring.
When I pressed Slater to elaborate, he added that Geoff “was Queensrÿche,” and the other guys have had a long enough time riding Tate’s coattails and taking advantage of his “hard work.” So the plan –according to Slater -- basically was for Geoff to leave Wilton, Jackson and Rockenfield high and dry and walk away, cutting their business out from under them.
